Alito & Abortion
Daisy Cutter has a EXTENSIVE review of Supreme Court nominee Alito and his decisions in relation to abortion. The current news is that 3 out of his 4 decsions favored abortion rights, but Daisy Cutter looks deeper to determine what the real story is to Alito decsions. Apparently DC has more confidence that Alito will overrule Roe than those who know him best or even Robert Bork.
Five judges who have served with Alito on the 3rd Circuit Court of Appeals say that, because of his conservative respect for precedent and stare decisis, he will not likely vote to overturn the Roe.

Meanwhile, Bork is not confident that he will do the right thing on abotion, “we do not know whether he will vote to overturn the worst constitutional travesties of the past” but we should nevertheless support him because he will at least do the right thing when it doesn’t come to protecting innocent human life.

DC and others forget that the battleground on abortion jurisprudence shifted dramatically in Casey, which conceded that Roe lacks any merit and upheld “abortion rights” entirely on the basis of precedent. Thus, it is not enough now to argue that Roe is “an abomination” and a “constitutional travesty.” Alito may very well agree, but his demonstrated undue respect for precedence and stare decisis suggests that he may reject the merits of Roe and still embrace Casey, thereby upholding abortion as a fundamental right.
Nothing he or anyone else has said in brushing these matters aside demonstrates otherwise, as I have explained more extensively elsewhere.

It is entirely unacceptable that we should have to “read between the lines.” With the last nominee, people objected that we should have no more stealth candidates, no more question marks, we should not have to simply hope and trust that the nominee is with us. Those people demanded that we have a “sure thing.”
Alito is not the “sure thing” that they insisted that we have, as DC admits when he says to “read between the lines.” He is worse than a question mark, he is worse than a stealth candidate. After Farmer, he is a presumptive pro-abort until clearly and convincingly proved to the contrary, and the arguments presented thus far, consisting of little more than hopes and prayers and wishful thinking, are far from convincing. “Trust me” is not good enough an analysis. At most, we are left with a gamble, and the odds are against us. We cannot take the chance. We cannot take that gamble; the stakes are too high.

Well Bender that is very informative stuff and thank you for sharing. Like you I do not go for the “trust me” line. Too many times “trust me” has lead to destruction of the goal, on both sides of the aisle. Long and short, we appreciate your comments because we love a good debate and we like to read what real people are thinking and saying. That is why we love blogs.
Personally, I have not decided how I feel about Alito yet. I see somethings that are positive, others that are negative. I plan to read as much as I can on the man, both sides, and then see how he does in the nomination process. With that said, IF Bush leaves him, up, which I think he will, then I do think Alito is on the court. I think the Republicans will stay togather on this and they can get 5 or 6 Democrats that will be getting pressure from home to back Alito.
